outrage, grief and the boogeyman...The boogeyman as promoted by the merdia press... Have you ever been in a classroom where the same pupils seem to always get the blame for misdeeds?... Whether it's the class bully or the poor simpleton, it's rare the real culprit for a misdeed is punished. I've seen some angelic clever kids doing their worst to see how someone would react for being blamed for something they did not do... The classroom needs its boogeyman... The western world needs its boogeyman. When Osama passed its use-by-date — a sad sod who had lost his influence in a changing world — he was unceremoniously taken out in a daring raid that had the added benefit of providing superman glory for the general in the White House. We could have hoped that with Osama being gone, the world would be safer... Ask the Iraqis about that... Since then, Osama has been replaced by various extremist leaders with names that are a bit too hard to remember, but it does not matter.... We have been primed to kick these extremist Muslim leaders in the guts, giving the entire Muslim community a bad smell. But the neo-fascist have also another boogeyman in another sphere of influence they want to loot. Thus when flight MH17 was taken out, straight away all the fingers pointed out Vladimir Putin. He is the capitalist neo-fascist boogeyman... They don't like him... He is a ruthless bully who stopped them from plundering Russia, which they were about to do under the banner of freedom (free for all who can steal the furniture, the resources and get away with interests to boot), when the Soviet Union collapsed. They hate him for that — and they will show as much as possible how Putin is a thug because in order to stop the rape of Russian by the west, he had to do a few unsavoury things, like sending a few oligarch to exile. Unlike Obama who of course has "clean hands" — despite having killed many more people with drones than died on flight MH17... (but of course those he killed were all baddies, except women and children who would have grown to become baddies) — Putin is so bad, that we, in the western neo-fascist world, think it's time to take him out. So we straight-away placed the blame for MH17 being shot out of the sky on Putin without any evidence of sorts, and we feel smug in our accusations while plastering our angry sorrows by the bucket load and reef ceremonies, onto the Russian guy — because we "know" he's done it... But there is a but. As the NSA spies on all our stuff, the Russians also spy on Ukraine. For the last few days, they would have had tried hard to understand what happened, since the finger is pointing at them, the boogeymen and they don't have a boogeyman themselves, so they are left carrying the can, they are the end of the line as far as the west is concerned... They can object all they want, we won't believe them... They are our boogeyman. They "did" it! Have we got any proof that the missile that destroyed MH17 came from Russia into the hands of rebels? No... but this does not matter at all. We've got a "hunch"... And we need to blame someone, don't we? The ruskies will do... Have we got any proof that the missile was fired by Ukrainian-Russian rebels? No... but we assume this, because they have downed Ukrainian planes up to 25,000 feet a few days before (so what was a civilian airliners doing in this very dangerous airspace?)... And of course, that "very incorruptible" new Ukrainian government told us and showed us pictures and transcripts and this and that... or is this part of the illusion to get our boogeyman? There is good chance that the missile was of Russian origin. We also know that the Ukrainian-Russian looted armaments from the Ukrainian army which mostly uses Russian hardware. This looting is where such a weapon could come from. As well we assume that the Ukrainian-Russian rebels do not have the expertise to fire such weapons. Balls! Some of the "rebels" would have been in the Ukrainian army at one stage or another. They would have the knowledge of the weaponry used and seem to be very much like an army rather than revolutionaries. A Russian general is now throwing a spanner in our gun-ho decision to blame Putin... And the general's explanation is very plausible. There was a Ukrainian SU25 flying nearby MH17 about 3 to 4 kilometres on the side at the same altitude. His radar logs tell him so. I would suggest that we also get the Ukrainian radar logs which were very active before MH17 was shot down, then had a reduced activity after the deed. Would it be possible that the missile was aimed at the SU25 and hit MH17 instead... Who knows. Would it be that the SU25 shot down MH17. What happened to the pilot of the SU25? Does this plane exist? The general was also intimating that the Ukrainians fired the missile — not the rebels... Why would they do that? Very difficult to say... Were they trying to embarrass the rebels? For downing a civilian plane? Or was the hands of the Ukrainian tied up with the CIA? We know the CIA has been operating Ukraine for a long time... I know it's conspiracy theory stuff, but it is as much a conspiracy theory as our blaming of Vladimir Putin square on, until we know what really happened. Meanwhile, as our own boogeyman Abbott demands the truth about the Russians, we're getting nothing about his ruthless activities on victimising boat people, under the vow of secrecy... and whatever... Shame Abbott, shame...

Tony Abbott has labelled interference at the MH17 crash site in Ukraine a “cover-up”, describing it as “evidence-tampering on an industrial scale”.
After the success of an Australian UN resolution calling for a full and secure investigation of the site, the prime minister continued to step up his rhetoric against pro-Russian rebels.
“After the crime comes the cover-up,” the Australian prime minister said, hours after his UK counterpart, David Cameron, accused separatists of shooting down the plane and warned Russia to change its approach.
"What we have seen is evidence-tampering on an industrial scale, and obviously that has to stop,” Abbott said.

Whilst I’m sure some would share the flat-earth world view of ‘Mordochland’, that prime minister Tony Babbitt has handled the MH17 crisis with uncustomary diplomatic aplomb thus far, there are others perhaps more cynical who sadly but simply see the turning of a terrible tragedy into an instant media circus to be used to pump-up all the old ‘cold-war’ rhetoric on behalf of our masters on the Potomac.
Does anyone really believe that Prime Minister Tony Abbott & the keeper of the ‘death stare’, Foreign Minister Julie Bishop, dreamt-up Australia’s attempted foreign policy mugging of Vladimir Putin all by themselves?

As to the alleged distaste by conservatives of our Security Council gig, surely old ‘Fishnets’ Alexander Downer proved just how much actors from that side of politics relish the prospect of being on the big stage?
Perhaps I would be more inclined to give the budgie smuggler the benefit of the doubt had he appeared less ready to poke Russia in the eye before the facts of the situation were even established. Add to this his persistent impugning of Russian intentions & we see the once-would-be-Jesuit for everything that he really is (it only takes one brief shining moment for those who care to look).
And as for G20 invitations, if I was Vladimir Putin, I think I’d be reaching for that old Groucho March epithet about not wanting to be a member of any club that would have him.

Malaysia Airlines flight MH17 may have been shot down by "mistake" by ill-trained pro-Russian separatists, US intelligence officials say, dismissing Moscow's accounts of the incident.
The officials said they decided to brief reporters partly to counter what they described as misleading propaganda from Russia and its state-controlled media over the incident.
Evidence gathered so far suggests separatists launched the SA-11 surface-to-air missile that blew up the Malaysian airliner, but it remains unclear "who pulled the trigger" and why, said a senior intelligence official who spoke on condition of anonymity.
"The most plausible explanation ... was that it was a mistake," and the missile was fired by "an ill-trained crew" using a system that requires some skill and training, an official said on Tuesday.
Intelligence officials are cautioning the public not to expect a "Perry Mason moment" when all questions are definitively answered.
They cited previous incidents over the years in which both Russian and US forces have mistakenly shot down civilian airliners.
A Korean airliner was downed by a Soviet fighter jet in 1983 and US naval forces mistakenly shot down an Iranian civilian passenger plane in 1988.
"We've all seen mistakes in the past," the official told reporters.

At the time of the downing of flight MH17, the airspace below 32,000 feet was closed to commercial airliners. Between you, me and a packet of budgie smugglers, there is very little difference between 32,000 and 33,000 feet as far as a war zone is declared. Ukraine would have had to know that the missiles used to down their planes at 25,000 feet were not toys and could go much further up. And was the SU25 shot down as well? Or was it a chimera in the imagination of a general...?

Tony Abbott hasn't wasted any time aspiring to get to know Vladimir Putin. Given a barn-door-sized cause for national moral outrage, a clearly identifiable villain and a rare opportunity to be a conduit for protest rather than the butt of it, the Prime Minister has not hesitated.
His language about Russia - right from the jump - was exacting and accusatory, although Putin might have struggled initially to register the Australian PM's insistence that he be "fair dinkum".
The dispatch of Julie Bishop - a woman who has spent her entire parliamentary career remaining cogent after long-haul flights and days on end without sleep - turned out to work perfectly.
Perhaps there is only room for one gym junkie at the G20. Perhaps all those years Abbott the right-wing student activist spent walloping the Trots lent Abbott the Prime Minister a certain fluency of expression. Perhaps it's the relief of certainty, in that rare geopolitical circumstance where the goodies and the baddies are distinguishable so easily from each other.
One year ago, one would not necessarily have expected a toe-to-toe between Vladimir Putin and Tony Abbott. One would not have anticipated these beyond-dreadful circumstances. And one would not, perhaps, have expected Australia's 28th prime minister either to have attempted so much, or to have got it so right.

Annabel! How can you get it so wrong? Our turdy Prime Minster just followed the hysteria with some added sympathetic decorum under instructions from Washington to heap as much crap as possible on Russia. But so far we have no proofs whatsoever of what happened. Even the yanks think of MH17 as an "accident"...
Yes, Australia has lost 36 people in the downing of MH17. But that does not mean much more than serious sorrow, grief and some anger. Our sorrow should focus on the lives lost, our anger should be placed at the inhumanity of war and a few other factors. For example the mob that Abbott leads should all be in prison for having lied to war on Iraq in 2003 and be responsible directly and indirectly for more than 500,000 deaths.
It has been known that there is a conflict in Ukraine. The Russian majority in East Ukraine demands freedom from Western Ukraine or at least some autonomy. Whether this is a good sentiment or a bad move is not for us to judge.
There is a war, with soldiers on both sides armed with fierce weaponry. We know that a few Ukrainian planes and helicopter have been shot out of the sky up to 25,000 fee recently. Does this mean that this is the range limit such weapons can go? I guess not... No, some of the weapons in the hands of the rebels, possibly stolen from the Ukrainian army, can go as high as 120,000 feet. That's what these are designed for: to shoot planes down.
So, this area in Ukraine is a war zone whether we blame Putin or not for it. Should Putin abandon the Russians in East Ukraine which for all count are nearly 80 per cent of the population? Should there be a compromise between Ukraine and the Russian of East Ukraine? Of course, but at the moment even in the Ukrainian parliament there are real fist fights about the situation...
For a couple of decades, there has been CIA (and MI6) operatives in Ukraine to cultivate that country's move towards the west and the west has recently been tempting (corrupting?) Ukraine with extra cash for dancing the tune.
Russia does not like it as it goes against the agreement made in good faith by the west and Russia when the Soviet Union bit the dust under Gorbachev. Thus whatever we might think of Putin as a thug, our own primal monster is a more of thuggish thug with policies at home that are neo-fascist to say the least. He and his mob have been shifting the goal posts to make sure the rich are getting more and the poor are getting less.
This my friend is far more ugly as it is a deliberate action while the shooting of MH17, a commercial airliner that should never been in that air space in the first place, is an "accident" as far as we know...

Britain is exporting millions of pounds worth of arms to Russia despite fears Moscow is arming the separatist rebels in Ukraine suspected of shooting down a Malaysia Airways plane, MPs have said.
A committee report said 251 licences for the sale of controlled goods worth at least £132m remained in force.
The PM has criticised other EU countries' arms deals with Moscow.
David Cameron's spokesman said the UK had not sold arms to Russia's armed forces since March.
He also said the arms export licences still in place were for "non-military legitimate reasons".
The cross-party Commons Committees on Arms Export Controls said only 31 UK licences had been halted or suspended.
Permits covering sniper rifles, night sights, small arms ammunition, gun mountings, body armour, military communications equipment and "equipment employing cryptography" remained in force, it said.
The government said it was keeping all licences under review and the majority of licences that remained in place were for "commercial use".

Mr Khodakovsky blamed the Kiev authorities for provoking what may have been the missile strike that destroyed the doomed airliner, saying Kiev had deliberately launched air strikes in the area, knowing the missiles were in place.
"I knew that a Buk came from Luhansk. At the time I was told that a Buk from Luhansk was coming under the flag of the LNR," he said, referring to the Luhansk People's Republic, the main rebel group operating in Luhansk, one of two rebel provinces along with Donetsk - the province where the crash took place.
"That Buk I know about. I heard about it. I think they sent it back. Because I found out about it at exactly the moment that I found out that this tragedy had taken place. They probably sent it back in order to remove proof of its presence."
"The question is this: Ukraine received timely evidence that the volunteers have this technology, through the fault of Russia. It not only did nothing to protect security, but provoked the use of this type of weapon against a plane that was flying with peaceful civilians," he said.
"They knew that this Buk existed, that the Buk was heading for Snezhnoye," he said, referring to a village 10 kilometres west of the crash site.
"They knew that it would be deployed there, and provoked the use of this Buk by starting an air strike on a target they didn't need, that their planes hadn't touched for a week.
"And that day, they were intensively flying, and exactly at the moment of the shooting, at the moment the civilian plane flew overhead, they launched air strikes. Even if there was a Buk, and even if the Buk was used, Ukraine did everything to ensure that a civilian aircraft was shot down."

Mr Khodakovsky said it was widely known that rebels had obtained Buks from Ukrainian forces in the past, including three captured at a checkpoint in April and another captured near the airport in Donetsk. He said none of the Buks captured from Ukrainian forces were operational.
"I'm not going to say Russia gave these things or didn't give them. Russia could have offered this Buk under some entirely local initiative," he said.
"I want a Buk, and if someone offered me one, I wouldn't turn it down. But I wouldn't use it against something that did not threaten me. I would use it only under circumstances when there was an air attack on my positions, to protect people's lives."
He added: "I am an interested party. I am a 'terrorist', a 'separatist', a volunteer ... in any event, I am required to promote the side I represent, even if I might think otherwise, say otherwise or have an alternative view. This causes real discomfort to my soul."

Slowly one can make something of what is being said. I can believe the rebels are truly sorry for the downing of MH17. The missiles most probably came from the Ukrainian army. There was a heightened aerial activity by the Ukrainian airforce in the area — as also indicated by the radar logs from Russia. It is a tragedy that in a "violent air space" where there was a cat and mouse battle going on, between Ukrainian airforce and ground rebel forces, a missile was launched and hit a passing airliner instead of a Ukrainian plane — possibly "the" SU25 flying very close to MH17. Such missiles are aimed at planes but can switch target automatically should they miss the original target.
What was an airliner doing in such an air space with no room to move is contentious. Why was the airspace open at 33,000 feet but closed at 32,000 is something for Ukraine to deal with, as they would have had to know that the missiles in the hands of the rebels stolen or acquired from their own army, are able to reach 120,000 feet.
A sad sorry episode of another war. And Putin had nothing to do with it, except possibly encourage Russian rebels in East Ukraine to hold to their beliefs that they are right and/or supply them with weapons, like the US does to Israel or the 'rebels in Syria...

Ukraine has accused rebels of shooting down two fighter jets on Wednesday close to where the Malaysia Airlines flight MH17 crashed, killing all 298 passengers on board.
A spokesman for Ukraine's military operations told Reuters the planes were hit near Savur Mogila, a burial mound in the Shaktersky region where a memorial marks ambushes by the Soviet army on occupying Nazis during World War Two.
But a separate statement from Ukraine's Security Council on Wednesday said preliminary information suggested the missiles had been fired from Russia. Moscow has not responded to the claim.
"Two of our jets were hit at an altitude of 5,200 metres. According to preliminary information, the missiles were launched from the territory of the Russian Federation," the council said.
The military jets were downed just 35 km (20 miles) from the MH17 crash site in the village of Grabovo in eastern Ukraine.

A leader of pro-Russian rebels in Ukraine has told the BBC that his forces do not possess the Buk missile thought to have been used to to bring down Malaysia airlines flight MH17.
Alexander Borodai, prime minister of the self-declared Donetsk People's Republic (DPR), said that evidence that showed otherwise was "fake".
All 298 people on the plane died when it crashed in east Ukraine last week.
Ukrainian pro-Russian rebels have been widely accused of shooting it down.
The Netherlands, where most of the victims were from, received the first bodies in a ceremony on Wednesday.
A second plane carrying more bodies is expected to arrive from Ukraine on Thursday.
'No Buks'
Mr Borodai rejected accusations that his men had neglected crash victims' bodies.
He also categorically denied the presence of the Russian-made SA-11 Buk missile system in the crash area. Western intelligence officials say this was the weapon used to shot down the aircraft.

From a reliable source, from that part of Europe:
Flight MH17 was flying only 1000 feet (300 metes) above a no-go zone for civilian aeroplanes (32,000 feet).
A very dangerous situation to be in.
About 3,000 metres (3 kms) to the north, a Ukrainian SU25 was flying on a parallel path, at a lower altitude (about 25,000 feet).
A Buk rocket was fired by rebels at the SU25
(the Buk missile came from looted stores of the Ukraine army)
The radar and anti-missile avionics of the SU25 detected the incoming missile
The pilot of the SU25 took evasive action and veered south east, (climbing to "coffin altitude" 33,000 for this aircraft) entering the "shadow" above MH17 by accident
The SU25 activated the anti-missile system which diverted the attention of the Buk missile
The anti-missile "shower" of the SU25 fell by accident very close above to MH17
The Buk missile exploded very close to MH17, taking it down.
OR
OR the SU25 climbed to 28,000 feet crossing the flight path below of MH17 while doing evasive actions.
The missile accidentally switched (confused) targets and picked the "largest one" only a few thousand feet above flying at about the same speed (mach 0.8)The radar logs should show.
Important note: The targeting system of the Buk missile has a "non-cooperative threat classification system" which identify and clearly distinguish civilian aircraft (radar) from potential military targets when identification of target is not clear from the launcher. This prevents "civilian" aeroplanes from being shot down. This is why the presence of an SU25 in the same air space would have confused signals.

Security officials in Ukraine say the downed Malaysia Airlines jet in eastern Ukraine suffered an explosive loss of pressure after it was punctured by shrapnel from a missile.
They say the information came from the plane's flight data recorders, which are being analysed by British experts.
However, it remains unclear who fired a missile, with pro-Russia rebels and Ukraine blaming each other.
Many of the 298 people killed on board flight MH17 were from the Netherlands.
Dutch investigators leading the inquiry into the crash have refused to comment on the Ukrainian claims.

The greatest concern about the events in the Ukraine that bothers me today is Rupert Murdoch’s deep involvement with politicians from various countries: Britain’s Thatcher and Blair in particular, American presidents from Jimmy Carter through to George W Bush and Australians from John Howard to Tony Abbott, Ariel Sharon to Benjamin Netanyahu.
How deeply have Rupert’s close and secret relations affected the range of wars that began after World War II and have continued through the 20th century into the 21st?
They are wars that were all unnecessary. They were all wars in which the Western powers and Australia were defeated – despite the lies of the politicians – who pretended afterwards that they had been successful.
North Korea, Vietnam, Iraq and Afghanistan were all costly defeats with horrible consequences for the people of those nations. In World War II, Russia’s Stalin took control of the countries to the East and the people of those countries have suffered ever since — some succeeding in different levels of freedom, others engaged in internal wars, like the Ukraine.
Wars sell newspapers and Rupert still lives in hope that he can bring his papers back to life. We will never know how much of his influence has caused so much suffering in these parts of the world.

Russia has introduced a "full embargo" on most food imports from Australia as part of a wide-ranging ban on foodstuffs from Western countries that is in retaliation to sanctions imposed against Moscow for its policy on Ukraine.
Australian farmers will feel the effects of the sanctions. Australian beef exports to Russia were worth $159 million in 2013, butter exports accounted for $64 million, live animals excluding seafood accounted for $55 million and meats excluding beef were worth another $48 million.
Overall, two-way trade between Australia and Russia in 2013 was worth about $1.79 billion in 2013, according to Department of Foreign Affairs statistics.
Those figures equated to $736 million in exports to the Russian federation and about $1.057 billion in imports from the Russian federation.
Late on Thursday, a spokeswoman for Prime Minister Tony Abbott said "we are examining the statement" from the Russian government.

Because the West wants to pin the downing of MH17 on Russia, Expert witnesses and experts from Russia seem to have been excluded from the Dutch investigation of the event. The Dutch team will report its findings in October this year. But one can expect that they will tow the line as decreed by Washington.

The Russian maker of an anti-aircraft missile widely thought to be behind the destruction of a civilian airliner over east Ukraine last summer presented evidence Tuesday that suggested that Ukrainian forces were responsible for the attack.

Based on the findings of a technical study of the MH17 wreckage, the firm concluded that a missile not used in Russia but found in Ukraine's arsenal destroyed the plane, and that the launch location was in territory allegedly held by Ukrainian forces.
But the appeal may fall on deaf ears. A report issued Sunday by a well-known team of citizen journalists concluded that similar claims made by the Russian Defense Ministry last summer were based on altered satellite photographs.
A report published by respected citizen journalist website Bellingcat on Sunday, meanwhile, cast doubt on Russian Defense Ministry satellite images released last summer that allegedly showed a unit of Ukrainian Buk-M1 launchers leaving their base and moving into the flight path of MH17.

Russian federal investigators said on Wednesday they had testimony from a former Ukrainian air force mechanic supporting a Moscow theory that a Malaysian passenger plane downed in east Ukraine last summer was attacked by a Ukrainian fighter jet.
Moscow has stepped up a campaign denying any responsibility for the downing of the airliner on July 17, 2014, with the loss of all 298 people aboard. Several versions presented by various Russian officials, however, are contradictory.
A state arms producer that makes the Buk air defense system believed to have brought down flight MH17 — though accounts differ on who fired it and from where — said on Tuesday the Boeing aircraft was hit by a missile deployed by Ukraine and not widely used by Russia's military.
Russia's federal Investigative Committee, which reports directly to President Vladimir Putin, said a Ukrainian mechanic had testified that an SU-25 military jet took off for a combat mission on July 17 and returned with no munitions.

AMSTERDAM — Dutch Foreign Minister Bert Koenders will discuss efforts to prosecute suspects in the downing of Malaysia Airlines flight MH17 while in Moscow on Friday, his office said in a statement.
Koenders will also discuss a Russian blacklist of European politicians during a meeting with his counterpart Sergei Lavrov, it said.
Roughly two-thirds of the 298 victims of the airline disaster on July 17 were Dutch. Suspects have yet to be identified by Dutch prosecutors.
The plane is widely believed to have been shot down with a surface-to-air missile launched by pro-Russian forces in Ukrainian territory, but Moscow denies involvement.

The vote on the proposal by Malaysia, Australia, the Netherlands and Ukraine to create an international tribunal is set for Wednesday afternoon. The resolution would require all countries to cooperate with the special tribunal or face sanctions.
But on Friday, Russian UN Ambassador Vitaly Churkin rebuffed the proposal. "This is not a proper thing for the Security Council to do because it's not a case of a threat to international peace and security," he said.
Ukraine is among a number of countries which accuse pro-Moscow separatists in eastern Ukraine of shooting down the Malaysia Airlines flight with a Russian-made missile in July 2014.
It crashed in territory held by the separatists, killing all 298 people on board. The majority of passengers on the MH17 flight from Amsterdam to Kuala Lumpur were Dutch.
Russia has objected to the formation of a tribunal, calling instead for the completion of an ongoing investigation, with conclusions expected in October.
Churkin said he had not received definitive instructions from Moscow on how to vote on Wednesday but commented: "I have a very strong feeling that it's not going to lead to a result that will be satisfactory for the Security Council." He added: "We are against it."
On July 21, 2014 the Security Council unanimously adopted a resolution for those responsible to "be held to account and that all states cooperate fully with efforts to establish accountability."
Led by the Dutch, Malaysia, Australia, Belgium and Ukraine are conducting a criminal inquiry into the downing of flight MH17.

The official investigation of the “Dutch Safety Board“ (DSB) and the “Joint Investigation Team“(JIT) was neither independent nor convincing. This kind of investigation forms a huge burden particularly to the families who lost their loved ones in the downing of MH17. They need to know the truth.
WE ARE ASKING YOU, TO PLEASE PUSH FOR A NEW INVESTIGATION. This could happen within an international framework like the U.N. comprising the following aspects:
(1) A team of international, independent scientists who would be able to exclude veto power for any government. (2) Keeping all scenarios on the table.
(3) Declassifying and releasing “available satellite images” claimed by Secretary of State, John Kerry, on 20th of July 2014; or (if not) disclaiming their existence.
(4) Conducting forensic examination of impact holes (for metal residues) in the MH17 wreckage and reproducing the same pattern of damage by shelling tests (as usually done in crime cases). Completing key information fields, such as body forensics, voice recorder, radar data etc.
(5) Prior construction of, a clear path to an international, objective trial in the U.N. framework with judges from countries which are not connected with the crash.
FURTHERMORE, WE ARE ASKING YOU TO PLEASE INITIATE PEACE TALKS WITH ALL PARTIES CONCERNED (including but not limited to Russia, Ukraine, and the EU) aiming at settling the dispute and establishing a reconstruction plan for Eastern Ukraine including the compensation of the MH17 families.

Lawyer does not offer customary full denial
London lawyer Samuel Wordsworth QC, a visiting professor at Kings College, is defending Russia in the ICJ against the Ukrainian Government's claims Vladimir Putin's federation is financially supporting terrorism by backing separatist rebels.
The case is a complicated one. The Wordsworth defence is interesting not only for what it says, but for what it doesn't say.
"There is no evidence before the court," he told the judges, "plausible or otherwise, that Russia provided weaponry to any party with the intent or knowledge that such weaponry be used to shoot down civilian aircraft, as would of course be required under Article 2.1."
(Article 2.1 is a key section of the International Convention for the Suppression of the Financing of Terrorism).
Mr Wordsworth did not run the normal Kremlin defence. Instead he said there was no evidence of intent to provide weapons to shoot down a civilian aircraft.

A MINI UPROAR has occurred in the wake of Pauline Hanson’s interview on last Sunday’s Insiders programme with Barrie Cassidy.
Hanson offered praise for Russian President Putin’s “strong leadership”.
An aghast Cassidy responded by repeating the standard lazy slur of Australian journalists that Putin was responsible for the shooting down of MH17 over eastern Ukraine in July 2014, with the loss of 39 Australian residents.
Prime Minister Malcolm Turnbull response was quoted in the Sydney Morning Herald:
'Mr Turnbull said Mr Putin’s Russia was responsible for the "shocking international crime" of shooting down the MH17 airliner.'
As a former barrister, Turnbull ought to know better than to definitively pronounce guilt before the evidence is available and properly assessed.
In the case of MH17, that caution should be exercised more carefully than with many political pronouncements. Unfortunately, Turnbull’s rhetoric only added to the obfuscation, evasion, omission of relevant facts and downright lies that have characterised political comment on the tragedy.
There has, in fact, been one report on the tragedy — that of the Dutch Safety Board (DSB), which reported on 13 October 2015. That report did not determine responsibility for the firing of the BUK missile, that the DSB concluded was responsible for the destruction of the airliner. Rather, they narrowed the likely origin of the missile to a 320 square km area that was contested at the time both by the Donbass militia and units of the Ukrainian military.
As is typically the case with official reports, there is more value found in the appendices than can be gleaned from the report itself.
In the case of MH 17, "Appendix T" was an assessment provided by the Dutch security services. Their analysis concluded that there was no evidence the “separatists” had possession of an operable BUK missile; no evidence that they had the training or expertise to fire such a missile and no evidence of any intention or motive to fire such a missile. Needless to say, none of this was reported in the Australian mainstream media.
The second report that has been published is an interim report of a criminal investigation team under Dutch leadership and including representatives of the Australian Federal Police (AFP).
Their deadline for producing a final report has been extended to 2018. Turnbull knows, or ought to know, that one cannot establish guilt on the basis of a preliminary investigation, much less when the preliminary report has not been subjected to the court procedures with which we are all familiar.
There are other serious reservations about the efficacy of even the preliminary report. That report has been dissected in a number of credible analyses that are readily available, so I will mention only two significant flaws to make the point.
The first is that the investigation team ignored, did not have available, or failed to include, relevant information from a number of sources. This included, for example, technical analyses, including classified information, by Almaz-Antay, the BUK’s manufacturer.
Another gap in the evidence was the data from the two U.S. satellites in geostationary orbit over Donbass at the relevant time — data which was boasted about by John Kerry shortly after the tragedy.
Fred Westerbeke, the Dutch head of the criminal inquiry, confirmed in a letter to the Dutch victim’s families in February 2016 that the American satellite data had been provided “confidentially” to the criminal investigation. The report, however, is silent about what those satellite images established. If they had confirmed what Turnbull rhetorically claims, it is a reasonable assumption that they would have been lauded long and hard.
The second major flaw in the report is that it relies heavily on information gathered by the Ukrainian authorities to reach its initial opinions. This breaches one of the fundamental principles of a criminal investigation. It even has its own Latin maxim, which translates as "no one is judge in their own cause".
Any “evidence” collected from such a source is inevitably irretrievably tainted. In the unlikely event of there ever being a criminal trial, or even a hearing of the various civil claims currently outstanding, this fatal flaw will provide ample ammunition for defence counsel.
The travesty of the inquiry does not stop there. In another development that the Australian mainstream media have never seen fit to enlighten their viewers/listeners/readers is the existence of an agreement signed by Australia, Belgium, Netherlands and Ukraine on 7 August 2014. This agreement provides that nothing shall be published arising out of the DSB or criminal inquiry unless all four parties agree. This effectively gives Ukraine a power of veto over any adverse findings. This is beyond astonishing.

The Sovershenno Secretno newspaper (translates as "Top Secret") conducts an investigation into the downing of the Malaysian passenger Boeing over Ukraine.
The copies of the documents that the newspaper obtained - orders, coded telegrams and plans - were written on official letterheads of the Ukrainian Security Service. According to the newspaper, Ukrainian President Poroshenko and his generals should be put on trial in The Hague as war criminals.
The person who handed the documents to the newspaper, said that it was part of his very long and exhausting work. "In Ukraine, I have a few friends, who are fed up with the fact that other people wipe their feet on them. They are two-faced guys: they want those bastards to be held accountable for what they did, but at the same time, they want a security cushion and offer to buy those documents," the anonymous source of information said.

First, the Ukraine government knew that some Buk missiles had been stolen from their arsenal. Buk Missile can hit up to 120,000 feet straight up.
Second, It has not been proven WHAT HIT MH17. It could have been down by a Ukrainian Buk missile, but...

The Ministry of Security and Justice of the Netherlands will not expose a number of documents related to the crash of Flight MH17 of Malaysia Airlines over the Donbass in 2014.
According to the Broadcasting Corporation of the Netherlands (HTK), the decision was made by the Supreme Court of the country. According to the court, "the right of the government to secrecy of its activities, the unity of state policy and sensitivity of the question outweigh the importance of disclosure."Thus, the Supreme Court of the Netherlands has revoked a decision of a lower court that earlier ruled that the information about the air crash should be exposed to the general public.
Shortly after the air crash over the Donbass, the Broadcasting Corporation of the Netherlands, RTL TV channel and Volksrant newspaper requested relevant information from the government to restore the sequence of actions of the authorities that followed the tragedy that occurred on July 17, 2014. The request from the media outlets was based on the law on freedom of access to information.
The Ministry of Security and Justice of the Netherlands published several hundreds of documents in February and April 2015, but most of information in them was retouched so much it was difficult to understand what the documents were saying.
It soon became clear that a whole package of documents on the subject had never been declassified. The department said, however, that exposing the data may complicate the relationship with other countries and international organisations.

In late February, the Dutch Ministry of Justice and Security released another report on the state of the ongoing MH17 crash investigation, which was conducted by the Joint Investigation Team (JIT), consisting of multinational specialists. The document did not provide any new details on the inquiry, instead, it stated that the probe had been “extended until January 1, 2019.”
The “detectives” still remain in the JIT “field office” in Ukraine’s capital of Kiev, where they continue to work “on the daily basis,” the document said. The investigators are also collecting the remains of the crash victims, more than three years after the tragedy. The paper also stated that some “bone fragments” obtained by a “freelance journalist”were handed over to the investigators over the past six months.
In January 2017, two Dutch journalists traveled to eastern Ukraine and one of them also visited the MH17 crash site only to discover that “a lot of pieces,” including some human remains, were indeed still lying on the ground, with no one apparently planning to collect them. A Ukrainian military pilot blamed by Russia over the 2014 downing of Malaysian Airlines flight MH17 has killed himself, Ukrainian media report, quoting police.
Capt Vladyslav Voloshyn had called the Russian allegation a lie. Dutch investigators concluded that a Russian Buk missile had destroyed the Boeing 777 jet, killing 298 people.
Reports say Voloshyn shot himself at home in Mykolaiv, near the Black Sea.
Ukraine described him as a war hero.
He had flown 33 combat missions in a low-flying Su-25 ground attack jet against Russian-backed separatist rebels in eastern Ukraine, and had been granted a medal for bravery.
Recently the 29-year-old had been in charge of the Mykolaiv airport, after resigning from the air force. The southern city near Odessa is called Nikolayev by Russian speakers.
A statement from Mykolaiv police on Facebook (in Ukrainian) described Voloshyn's death as "suicide", but it is being investigated under the "premeditated murder" section of Ukraine's penal code.
A military service pistol was found at the scene and is now being examined by experts.

Radar boffins have debunked the 'invisible missile' theory that Russia used in an attempt to discredit the investigation into the crash of Malaysia Airlines flight MH17, in which 38 Australians died.
Russia had claimed “irrefutable” raw radar data showed no missile was fired at the flight from the area that Western investigators including Australian federal police had established - a part of eastern Ukraine under the control of Russia-backed rebels.
But independent aviation experts said the radar data proved no such thing: and Russia may even have manipulated the data to hide its tracks.
The experts appointed by a magistrate from the Netherlands Public Prosecution Service examined data that Russia handed over and concluded either the missile was moving too quickly to be picked up by radar, or the data showing its presence was “removed manually”.
“Australia recognises and appreciates the findings of the independent experts’ assessments of the radar images provided by the Russian Federation,” said Peter Crozier, Commander of the Australian Federal Police, in a reaction to the results of the experts’ examination. “The findings are consistent with the previously articulated position of (investigators).”

Dutch investigators have claimed they've uncovered hard evidence that the missile system that had shot down MH17 over East Ukraine in 2014 was part of the Rusian military.
The missile, which downed Malaysia Airlines Flight MH17 in eastern Ukraine in 2014, was launched by the Buk TELAR belonging to the Russian Armed Forces, head of the Dutch National Police’s Central Crime Investigation department Wilbert Paulissen said Thursday.
"The JIT has come to the conclusion that the Buk TELAR by which the MH17 was downed originated from the 53rd Anti-Aircraft Missile Bridage [sic], or the 53rd Bridage [sic], from Kursk in the Russian Federation," Paulissen told a press conference organized by the Dutch-led JIT.
According to JIT, the missile system was allegedly delivered to territories in eastern Ukraine that were beyond Kiev's control at the time of the incident and subsequently returned to Russia after the crash.
Dutch Chief Prosecutor Fred Westerbeke stated however that the investigation team will not disclose the evidence allegedly uncovered.
"We have more evidence and more information to back the conclusions made today, but we will not make them public at this time," he announced.

The Russian Defense Ministry has rejected new claims that flight MH17 over Ukraine was downed by a missile from a Russian unit, urging the Dutch-led probe to focus on studying hard facts instead of social media images.
“Not a single anti-aircraft missile system of the Russian Armed Forces has ever crossed the Russian-Ukrainian border,” the defense ministry said in statement.The Russian military raised eyebrows over
“the determination of the Dutch-led investigation to justifying its conclusions by solely using images from social networks that have been expertly altered with computer graphic editing tools.”
The ministry pointed out that the images used in the Joint Investigation Team (JIT) press conference on Thursday were provided by the Ukrainian special services and had been previously displayed by the infamous British online investigative activist group, Bellingcat.
The Dutch-led probe announced that the missile that downed Malaysia Airlines flight MH17 in July 2014 came from a Russian military Buk system that crossed into Ukraine and then returned to its base in western Russia.
Investigators claim the missile system involved came from “the 53rd Anti-aircraft Missile Brigade based in Kursk in Russia”. The JIT essentially just repeated the conclusion made by Bellingcat a year ago.
The alarming part in the JIT probe is that “the Dutch investigators completely ignore and reject the testimony of eyewitnesses from the nearby Ukrainian communities”, according to the Defense Ministry. The testimonies, however, provided essential information “indicating the launch of a missile was carried out from a territory controlled by the Ukrainian Armed Forces.”
The Russian side said that it provided the international probe with “comprehensive” evidence, including field tests, which “clearly indicate the involvement of the Ukrainian Buk anti-aircraft system units” in the destruction of the plane with 283 passengers and 15 crew members onboard.

What should shake your confidence in this "lynching", comes from the Dutch who said "Russia had so far failed to cooperate "at all" with the criminal investigation into the incident" — but the truth is that Moscow was not allowed to take part in the investigation, despite giving evidence that were dismissed by the investigators. MOSCOW (Sputnik) – The United States has not showed satellite images related to the Malaysia Airlines Flight MH17 crash in eastern Ukraine in 2014 that it claimed to have after the accident, Russian Foreign Ministry spokeswoman Maria Zakharova said Friday.
"It is also worth mentioning that the United States has not provided satellite images, the presence of which was announced immediately after the catastrophe," Zakharova said as quoted on the website of the Russian Foreign Ministry.
Earlier in the day, the Russian Defense Ministry refuted allegations by the British-based group Bellingcat that Russian intelligence officers were involved in the downing of MH17.

There are two serial numbers found on fragments of the missile, which shot down the passenger airliner in June 2014 according to an international team of investigators led by the Netherlands. The numbers were marked on the engine and the nozzle of the missile.
The Russian military on Monday said they had traced them to a missile which had the producer serial number 8868720.

French investigators have reportedly uncovered new details in their hunt for the missing Boeing MH370 which disappeared en route from Kuala Lumpur to Beijing over four years ago.
According to Chyslain Wattrelos, a Frenchman whose wife and two children were among the 239 people onboard the ill-fated Malaysian Airlines flight, the screening of MH370 passengers has raised a number of questions.
'Atypical' Profiles
Chyslain Wattrelos, who recently met with the judge in charge of France's Air Transport Gendarmerie probe, says that French investigators have uncovered a Malaysian passenger with aeronautical knowledge sitting under the satellite communications module, hinting that he could have hacked the plane.
Other curious individuals onboard include two Ukrainians and one US national with "atypical profiles," as well as an Iranian, who had allegedly asked on Facebook to pray for him days before the flight.
MH370 Hunt Extends to US
Wattrelos added that investigators hoped to go to the US to meet with the FBI, which analyzed hard drive data from MH370 captain Zaharie Shah's home flight simulator, and with Boeing representatives in a bid to obtain and re-examine raw data. A previous trip was scrapped in September after the FBI opposed "confidentiality clauses" and "Boeing's trade secrets."

"We are a little angry and now we want to say stop, it is time that the United States really cooperate on this issue," said Ghyslain Wattrelos. "It is necessary to go there because there are three entities that hold important information for understanding what happened on this flight."
A ‘Third Entity' Keeping Secret Data?
The Air Transport Gendarmerie's investigators have also uncovered a third entity, referred to by Wattrelos as SITA, a Swiss-based company that provided satellite communication services to Malaysian Airlines. The task is now to find out whether SITA's software was capable of hacking Satcom, the antenna that communicates signals from the aircraft to the Inmarsat satellite.
Wattrelos further pointed to what he called the yet-unexplained inconsistencies in the Malaysian report: for instance, Malaysian investigators said that the aircraft climbed to 58,200 feet (nearly 17.7 km) at some point, while the Boeing 777's actual cruising altitude is 43,000 feet (over 13 km).
Additionally, the co-pilot is said to have made a call from his mobile phone just before the plane disappeared from radars, but no similar data is available yet about any of the remaining 239 passengers and crew.
France remains the only country still investigating the Boeing's disappearance, after Malaysian authorities scrapped their four-year, multimillion-dollar search for the plane. In July, they admitted that they didn't know what happened to the plane, while also claiming that it was switched to manual control before disappearing from radars.
Malaysia Airlines Flight MH370 vanished from radar screens on March 8, 2014 on its way from Kuala Lumpur to Beijing during a handover from Malaysian to Vietnamese air traffic controllers. Only a few pieces of debris, thought to be parts of the wreckage, have been discovered at different locations, including the French island of Reunion in the Indian Ocean, as well as in South Africa and Mozambique.

Yesterday we had a meeting with the French judges in charge of the investigation (the only investigation I trust). This investigation is progressing well thanks to the SRGTA, which does a lot of work. However, there is still a lack of international cooperation to move faster. The key conclusions of this meeting are:
* Judges ask to go to the US for a year and a half; all of the excuses to cancel this trip are coming from the American side (at first it was "you can come but you sign a confidentiality agreement" now it's "Boeing must protect these trade secrets"). It is very important to go on site to question the FBI, Boeing and a company that sells devices to the "program", SATCOM.
* The SITA company that managed most communications between the plane and the satellites could not connect to the aircraft while Inmarsat was successful. Conclusion: either Inmarsat or SITA lied!
* Passengers screening has raised questions that will have to be answered.
A Malaysian passenger sitting under the SATCOM had very good aeronautical knowledge (could he have hacked the SATCOM?)
An Iranian asked to pray for him on his Facebook account a few days before.
Two Ukrainians and one American also seemed to have atypical profiles.
* The Malaysian reports are riddled with inconsistencies that will have to be sorted out with Malaysia:
- Plane went to 58,000 feet while the 777 can not go above 43,000 !!
- Only the co-pilot's cell phone terminal was connected. None of the other 239 people on board was !!!
Note from Gus: for a plane like the 777 to reach 58,000 feet where the atmosphere is about 20 per cent the density at ground level, it needs to have more wing surface. This can be achieved by going at full cruising speed while extending the flaps to add more lift. A plane like the U2 can reach 70,000 feet where the atmosphere density is about 10 per cent of that at ground level, but it is designed like a glider with massive wings for the size of the plane.

What everyone knew about the 2014 downing of Malaysia Airlines Flight 17 got more official this week, as an international team of prosecutors charged three Russians and an allied Ukrainian in the murder of all 298 people aboard the plane.
Though Moscow and its puppets in occupied eastern Ukraine continue to deny everything, it was clear from the start that the missile that took out MA17, en route from Amsterdam to Kuala Lumpur, was fired from areas controlled by Russian-sponsored forces.
Officials from the Netherlands, Australia, Belgium, Malaysia and Ukraine have worked together on the Joint Investigation Team since shortly after the crash, with the Dutch leading because so many of the victims were their citizens.
And the JIT now says it has proof “that Russia provided the missile launcher” and has filed charges against four figures at the heart of the transfer — all of them involved in the Moscow-created Ukrainian separatist movement. Igor Girkin, Sergey Dubinsky and Oleg Pulatov all have ties to Russian military and security services; Leonid Kharchenko is the lone Ukrainian.
They’ll likely be tried (in the Netherlands) in abstentia, since Moscow will never cough them up. After all, if they started singing, it would only help show that responsibility goes all the way to the Kremlin.
We can’t say that Russian autocrat Vladimir Putin intended his pawns to shoot down a civilian airliner. But his regime sponsored a “rebellion” and armed the forces that committed this war crime.
Just one more reason the rest of the world should treat Putin as the scum that he is.
