Meanwhile, Attorney-General Philip Ruddock says it is best that people do not comment publicly on the case.

"We would expect that in Australia, we don't expect that people would be out there arguing in relation to a person who has been charged with offences about the appropriateness of it," he said.

"We believe the court and in this case the tribunal ought now to get on with its job."

Use of coerced evidence possible in Hicks trial: Ruddock

Federal Attorney-General Philip Ruddock says it is possible that evidence obtained coercively could be used against Guantanamo Bay detainee David Hicks.

Hicks, originally from Adelaide, has been held at Guantanamo Bay prison in Cuba since 2002 and is facing charges of attempted murder and providing material support for terrorism.

Mr Ruddock has again expressed the Government's frustration at the length of time it has taken to bring Hicks to trial. He says he has been told that coercive means such as sleep deprivation and questioning for up to 20 hours have not been used on Hicks.

But Mr Ruddock has told ABC television's The 7.30 Report it is possible that evidence gathered in that way from others might be used in the case against Hicks.

"The test is whether the evidence given, the way in which it was obtained is believable," he said.

David Hicks has been on toilet paper "rations" because some Guantanamo Bay detainees - but not the Australian terror suspect - have been using it to cause flooding.

Rod Smith, a senior consular officer from the Department of Foreign Affairs and Trade (DFAT), said Australian officials were first alerted to this problem in early November last year.

"Toilet paper is rationed to 30 sheets at a time but additional supplies can be provided as requested," Mr Smith said.
