Shadow attorney-general Mark Dreyfus has had a court victory over the current minister, George Brandis, with the Administrative Appeals Tribunal overturning Senator Brandis' refusal to release his ministerial diary.

In an embarrassing decision for the federal Attorney-General, the head of the tribunal Justice Jayne Jagot on Tuesday found that he had "no practical reason" to reject Mr Dreyfus' request for access to the diary schedule under freedom of information laws.

Mr Dreyfus had personally taken the case to court, arguing that the public needed to know who Senator Brandis had been meeting with in the lead up to a series of significant government decisions, including cutting funding to legal centres across the country.

She also dismissed the estimated amount of time required to process the request.

"I accept that the work will not be trivial or insignificant," she said.

"But that does not mean that such work is likely to involve a substantial interference with the performance of the Attorney-General's functions".

Earlier, Mr Dreyfus told the tribunal that his request was a "simple" one, as shown by a similar release of a month's entries from Foreign Minister Julie Bishop's diary.

But Senator Brandis's chief of staff Paul O'Sullivan told the hearing the diary's release could reveal patterns of behaviour, leading to personal security issues.

Mr Dreyfus argued there was an "undeniable public interest" in its release, and the Attorney-General's office had misconceived the exemptions that existed under the Freedom of Information Act.

Federal Attorney-General George Brandis is appealing against a tribunal decision forcing him to reconsider handing over his electronic diary to his Opposition counterpart.

The ABC understands lawyers for Senator Brandis contacted shadow attorney-general Mark Dreyfus' office on Tuesday afternoon, informing them of their intent to take the matter to the Federal Court.

In December, the Administrative Appeals Tribunal found Senator Brandis's office had been wrong in rejecting a freedom of information (FOI) request from Mr Dreyfus for a print out of the Attorney-General's weekly electronic diary for dates between September 2013 and early 2014.

Mr Dreyfus wished to examine who Senator Brandis was meeting in the lead-up to key policy decisions in his portfolio.

Senator Brandis's chief of staff, who was in charge of considering the original FOI application, rejected the request on the basis it would substantially interfere with the Attorney-General's ministerial function.

It was argued Senator Brandis would have to sit down with his staff and personally inspect each diary entry before giving it approval to be released.

Justice Jayne Jagot found no practical reason for refusing the FOI request.

She said she was not satisfied by arguments that releasing the diary would result in security concerns, as it could indicate "regular movements or arrangements" the Attorney-General keeps.

Her ruling did not mean the diary would have to be handed over immediately, rather Senator Brandis's office would need to reconsider the application.

Federal Attorney-General George Brandis has lost his latest bid to keep his ministerial diary private, after a long-running Freedom of Information (FOI) dispute with his Labor counterpart Mark Dreyfus.

This morning the Full Court of the Federal Court in Sydney ruled against Senator Brandis, who had argued the FOI application from Mr Dreyfus would have interfered with his daily duties and taken hundreds of hours to process.

It does not mean the diary must be released immediately, rather, the FOI request has to be reconsidered.

The Commonwealth has been ordered to pay court costs.

Mr Dreyfus represented himself during the matter and said his appearance cost nothing.

"I hope [Senator Brandis] learnt a lesson from this. He's now cost the Australia taxpayer well in excess of $50,000," Mr Dreyfus told reporters outside the Federal Court.

"I call on Senator Brandis to now say definitively that he will not be wasting further taxpayer money by going on to the High Court of Australia, which he could potentially do.

"Instead, he should expeditiously process this request, which was always a simple request."

We want to know with whom you held political congress mere weeks before cigar "Smokin Joe" Hockey brought down his disreputable 2014-15 Budget, that included the brutal slashing of millions of dollars from the nation's already bankrupted legal aid system.

And so does Mark Dreyfus. A former Commonwealth attorney-general himself for several years, the now shadow attorney-general and minister for the arts (coincidentally, another unlikely portfolio also held by Brandis) has been involved in a freedom of information bid to access the diary of his nemesis, Attorney-General George Brandis QC. Brandis has been doing everything possible to counteract Dreyfus.

DREYFUS HAS SHARPER BRAIN, BUT BRANDIS RULES

Whilst Dreyfus is the sharper legal brain, Brandis has now positioned himself above the prime minister and the queen's man, Governor-General Sir Peter Cosgrove.

The diary is an electronic work diary. Brandis claims it will take years of work hours to go through the e-diary. Bollocks. We all know this to be untrue. 

It seems the Full Court of the Federal Court thinks so too.

Because on Tuesday, Brandis lost yet another attempt to thwart the course of justice. His appeal was dismissed.

It is time for him to come clean and bare all.

George Brandis has been the most incompetent attorney general of Australia... He should sack himself.
Brandis was educated by the Catholics. I know the Catholics in rich private schools. They educate young little shits to become annoying captains of society. Those who don't make the cut in politics, end up becoming priests, brothers or work for the police. One word: Network... Sorry I am a bit harsh here. But should the Catholic school ware shows any inclination of becoming a sociopath, or a ruthless one track-mind philistine or a bully, the good brothers will transform him into a future trench-warfare general — by making him swallow the purposed duty of being a chosen holy soldier, which added to the sociopathy is like being a dedicated hypocrite without the humility of being god.

The Catholics love transforming brats into leaders full of ship: Abbott, Baird, Brandis, etc.

And there is not a single trace of humility in Brandis. The way he designated himself above experts of the arts council stinks of a Leonardo's delusion and self-appointed virtuoso on deciphering the Da Vinci Codes. I can imagine studious Brandis, in his office full of bookshelves, decoding the bullshit with the zeal of a fibbing forger.

The man shined when he declared himself the decider of what's good art or not. I can't even do that and I am a fully fledge professional artist. Well I am a sod-off of an artist doing cartoons on the side, for fighting for justice the cartoonistic way — not unlike Superman and Spiderman, who are no more than spoofy characters to occupy the mind of the plebs with hope of a supernatural dick. So I really got offended by Brandis' decision to spiffle more than 100 million worth of bickies for his own, possibly private but definitely, personal artistic appreciation. "Art appreciation" is mostly a north-shore retirement village subject, like basket weaving and quilt making, for seniors and seniorettes who don't want their brains turning to soup before tea time.
No wonder the art community was up in arms. Brandis should have sacked himself for glowing pink in the dark.
Despite a court order, Brandis refuses to hand over his diary, not his personal diary, but that of the Attorney General which is a PUBLIC office function. Why? What has he got to hide? Now that the second court has rejected his rejection, I have the niggling feeling that actually Mark Dreyfus actually knows what's in the dairies and this is why he wants them made public as they should be anyway and this is why the master of red faces, Brandis, wants to hide what he has done and who he invited to his table...

Federal Labor is trying to push contempt of court proceedings against Attorney-General George Brandis, arguing he is not taking an order relating to his ministerial diary seriously.

Senator Brandis and his counterpart, Shadow Attorney-General Mark Dreyfus, have been locked in a stalemate for almost three years.

Mr Dreyfus lodged a freedom of information (FOI) request to access an electronic copy of the Attorney-General's diary, to see who he met with before sweeping cuts hit his portfolio in the 2014 federal budget.

That request was initially blocked by Senator Brandis's office, who argued it would take too long to process because he would have to personally approve the release of every item.

Mr Dreyfus successfully appealed that to the Administrative Appeals Tribunal (AAT), who told Senator Brandis's office the FOI needed to be processed.
